Terms of Service

1. Acceptance of Terms

By accessing or using BrewmyApp ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service. We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a notice on our website. Your continued use after such notice constitutes acceptance of the updated Terms.

2. Description of Service

BrewmyApp is a software-as-a-service (SaaS) platform that enables eCommerce store owners (including Shopify and WooCommerce merchants) to design, build, and manage native mobile applications for iOS and Android - without writing code. The Service includes:

  • A flexible block-based app builder that allows you to design every screen of your mobile application by adding, removing, and configuring sections — without requiring coding or design experience.
  • Professionally designed screen templates to help you quickly create and customize your app’s layout and structure.
  • Full control over app design, including layouts, colors, typography, and reusable components such as banners, product grids, categories, and promotional sections.
  • Automated cloud-based app builds for iOS and Android via Expo Application Services (EAS).
  • Shopify and WooCommerce integrations to sync products, categories, orders, and related store data to your app.
  • Over-the-air (OTA) updates to push changes to your published app without resubmitting to app stores.
  • Push notification delivery for order status updates to your app’s end-users.
  • A real-device preview system for testing your app before publishing, with changes reflected in near real-time.

3. Account Registration

You must create an account to use the Service. You may register using email and password or Google OAuth. You agree to provide accurate, complete information and to keep your account credentials secure. You are responsible for all activity under your account.

4. Subscriptions & Payment

BrewmyApp offers a free preview experience and paid build services. Users can design, configure, and preview their mobile applications at no cost. Charges apply only when a user initiates a build.
By using paid features, you agree to the following:

  • App design, configuration, and preview are provided free of charge. Charges are applied only when you choose to build your application.
  • Payments are processed by Paddle, our merchant of record. By initiating a paid build, you authorize Paddle to charge the applicable fees.
  • Pricing may be based on a per-store subscription, build usage, or other applicable pricing models as described on our pricing page.
  • Subscriptions (if applicable) are billed on a recurring basis and renew automatically unless cancelled. Each subscription applies to a single connected store (Shopify or WooCommerce).
  • App builds may be subject to limitations or dependencies on third-party services (such as Expo Application Services). Availability and limits may change based on such services.
  • You may cancel any active subscription through your dashboard. Cancellation takes effect at the end of the current billing period.
  • We reserve the right to change pricing with prior notice. Any changes will not affect ongoing billing cycles but will apply to future charges.
  • Refunds, if any, are governed by our Refund Policy.

5. WooCommerce Store Connection

To use the Service, you must connect a supported eCommerce store (such as Shopify or WooCommerce) by authorizing BrewmyApp to access your store’s data via OAuth, API keys, or other supported authentication methods.

You represent and warrant that you have the authority to grant this access and that your use of the Service complies with all applicable laws and platform policies.

You are solely responsible for the content, legality, accuracy, and compliance of your store’s products, pricing, customer data, and operations.

  • For WooCommerce stores: BrewmyApp requires installation of a companion WordPress plugin to enable features such as authentication, data synchronization, and push notifications.
  • For Shopify stores: You must install the BrewmyApp application from the Shopify App Store and grant the required permissions through Shopify’s OAuth process. BrewmyApp accesses only the data necessary to provide the Service in accordance with Shopify’s API Terms and policies. Certain features, such as OTP-based authentication for end-users, may require integration with third-party services (e.g., Brevo).

BrewmyApp does not process or store payment information from your store’s checkout. All transactions are handled by your respective platform and its configured payment providers.

6. Acceptable Use

You agree not to use the Service to:

  • Violate any applicable laws, regulations, or third-party rights.
  • Distribute malware, spam, or harmful content through apps built on the platform.
  • Build apps that promote illegal activity, fraud, phishing, impersonation, hate speech, harassment, or otherwise violate the policies of the Apple App Store, Google Play Store, Shopify, or WooCommerce.
  • Attempt to gain unauthorized access to our systems, other users’ accounts, or connected stores (including Shopify and WooCommerce stores).
  • Reverse-engineer, decompile, disassemble, or attempt to extract the source code of any part of the Service or generated mobile applications, except as permitted by applicable law.
  • Abuse build resources, rate limits, or API quotas, including using automated tools or scripts to trigger excessive builds or requests.
  • Misuse customer data obtained through the Service, including unauthorized collection, storage, or sharing of personal data.
  • Resell, sublicense, or redistribute the Service without prior written consent from BrewmyApp.

7. Intellectual Property

You retain ownership of all content, data, and branding assets that you upload or create using the Service (e.g., app icons, splash screens, design configurations).
Subject to your compliance with these Terms, you retain rights to use the mobile application generated for you through the Service.
BrewmyApp retains all rights, title, and interest in and to the Service, including its platform, underlying technology, infrastructure, templates, and all related intellectual property.
You are granted a limited, non-exclusive, non-transferable license to use the generated mobile application in connection with your connected store (including Shopify or WooCommerce) for the duration of your active subscription.

You grant BrewmyApp a limited, non-exclusive license to use, process, and display your content solely for the purpose of providing, maintaining, and improving the Service, including building, hosting, and delivering your mobile application.

8. Generated Apps & App Store Compliance

Apps built through BrewmyApp are published to the Apple App Store and/or Google Play Store under your own developer accounts.

you are responsible for:

  • Maintaining valid developer accounts
  • Complying with all applicable app store guidelines and policies
  • Providing accurate app metadata and disclosures
  • Handling end-user support, complaints, and requests
  • Ensuring your app content complies with all applicable laws and regulations

You are also responsible for complying with the terms and policies of any connected platforms, including Shopify and WooCommerce.

BrewmyApp does not guarantee that your application will be approved by any app store and is not responsible for app rejections, removals, suspensions, or policy violations imposed by app store providers or third-party platforms.

9. Third-Party Services

The Service integrates with third-party platforms and providers, including Shopify, WooCommerce, Paddle, Expo, Amazon Web Services, Google (OAuth), Brevo, and others.
Your use of these services is subject to their respective terms, policies, and data practices.
BrewmyApp does not control and is not responsible for the availability, functionality, security, or practices of third-party services.
Downtime, API changes, policy updates, or service disruptions from these providers may impact the functionality or availability of the Service.

10. Service Availability & Disclaimers

The Service is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee:

  • That app builds will be successful or error-free
  • That generated applications will be approved by Apple App Store or Google Play Store
  • That the Service will be uninterrupted, secure, or free from errors

BrewmyApp is not responsible for:

  • App store rejections, suspensions, or removals
  • Downtime, failures, or disruptions caused by third-party services (including Shopify, WooCommerce, Expo, cloud providers, or payment providers)
  • Loss of data, revenue, or business resulting from build failures, deployment issues, or service interruptions

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

11. Limitation of Liability

To the maximum extent permitted by applicable law, BrewmyApp shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.

This includes, without limitation:

  • Loss of revenue, profits, or business opportunities
  • Loss of data or content
  • App store rejections, suspensions, or removals
  • Downtime or disruptions affecting your Shopify or WooCommerce store

Our total aggregate liability for any claims arising out of or relating to the Service shall not exceed the total amount paid by you to BrewmyApp in the twelve (12) months preceding the event giving rise to the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless BrewmyApp and its officers, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • The content, products, or operations of your Shopify or WooCommerce store
  • Your generated mobile application, including any infringement of third-party rights or violation of applicable laws

13. Termination

We may suspend or terminate your account at any time if you violate these Terms, engage in abusive or fraudulent behavior, or fail to pay applicable fees.

You may request account deletion by contacting us at privacy@brewmyapp.io.

Upon termination:

  • Your right to access and use the Service will cease immediately
  • Your applications may stop receiving updates and may lose functionality
  • Your data may be retained for a limited period in accordance with our Privacy Policy, after which it may be deleted or anonymized

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes arising out of or in connection with these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in Raipur, Chhattisgarh, India.
